These Terms of Service ("Terms") govern your access to and use of Fortely (the "Service"), an automated website monitoring product that runs scheduled crawls against sites you configure and reports on SEO, performance, accessibility, and security. By creating an account or using the Service you agree to these Terms.
Fortely is operated as "Fortely" ("we", "us", "our"). If you do not agree to these Terms, do not use the Service.
You need an account, authenticated via our identity provider, to add sites or view scan results. You are responsible for keeping your login credentials secure and for all activity under your account. You must provide accurate information and promptly update it if it changes.
You must be at least 18 years old, or the age of majority in your jurisdiction, to create an account.
Fortely crawls the URLs you configure, on a schedule you choose, on your behalf. You may only submit websites that you own or that you have clear authorization to scan. You are solely responsible for confirming you have permission to crawl any URL you add.
You agree not to use the Service to:
Fortely offers a free scan and paid subscription plans (currently Pro and Business), billed monthly or annually. By subscribing to a paid plan you authorize us (or our payment processor) to charge your payment method on a recurring basis until you cancel.
You can cancel at any time; cancellation takes effect at the end of the current billing period and you retain access until then. Fees already paid are non-refundable except where required by law. We may change plan pricing or features with reasonable advance notice; continued use after a price change takes effect constitutes acceptance.
Fortely's SEO, performance, accessibility, and security checks are automated and provided for informational purposes only. They are not a guarantee that your site is fully optimized, accessible, or secure, and they do not constitute legal, accessibility-compliance, or security-audit advice. You remain responsible for your own site's compliance with applicable laws and standards.
We do not guarantee that scans will be uninterrupted, error-free, or catch every issue, and scan schedules may be delayed by factors outside our control (including the target site being unreachable).
The Service relies on third-party infrastructure to operate, including authentication, database hosting, application hosting, and email delivery providers. Your use of the Service is also subject to the availability of these providers, and an outage on their end may affect Fortely.
We own the Service, including its software, design, and branding. You retain all rights to your own site content; submitting a URL for scanning does not transfer any ownership of that content to us. We may use aggregated, de-identified data about how the Service is used to improve it.
THE SERVICE IS PROVIDED "AS IS" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED. TO THE MAXIMUM EXTENT PERMITTED BY LAW, FORTELY WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, OR CONSEQUENTIAL DAMAGES, OR FOR ANY LOSS OF DATA, REVENUE, OR BUSINESS ARISING FROM YOUR USE OF THE SERVICE. OUR TOTAL LIABILITY FOR ANY CLAIM RELATING TO THE SERVICE WILL NOT EXCEED THE AMOUNT YOU PAID US IN THE 12 MONTHS BEFORE THE CLAIM AROSE.
You may stop using the Service and delete your account at any time. We may suspend or terminate your access if you violate these Terms, including the acceptable-use rules in Section 3. On termination, your right to use the Service ends; we handle any retained data as described in our Privacy Policy.
We may update these Terms from time to time. If we make material changes, we will post the updated Terms here with a new "last updated" date. Continued use of the Service after changes take effect means you accept the revised Terms.
These Terms are governed by the laws of the State of Wyoming, USA, without regard to conflict-of-laws principles. Any dispute arising from these Terms or the Service will be subject to the exclusive jurisdiction of the courts located in Wyoming.
